Applicability of Our Conditions of Sale
Each order placed with us (“Mark Legere Collections” or “M. Legere”) or any of our affiliated companies by means of this website, mobile apps, telephone or in our boutique shall be governed by this Conditions of Sale. They shall apply to the exclusion of all other conditions. By using this website and by placing an order with us, you acknowledge that you have read, understood and accepted, without reserve, our Conditions of Sale. We invite you to read this section carefully before using the services provided by us.
Mark Legere Collections reserves the right, at any time, to modify these Conditions of Sale by posting a new dated version on this website. By placing an order with us after we have posted a new version of our Conditions of Sale, you agree to be bound by that updated version.
Create an Account
When you create an account on this website, you must ensure that the information you provide is correct and complete. Please inform us about any changes of address or other modifications by updating your personal data without delay.
When you create an account on this website, you will be asked to create a password. You must keep this password strictly confidential and not disclose it or share it with anyone. You are fully responsible for the use of your password and any orders placed under it, even without your knowledge. If you know or suspect that someone else knows or has used your password, you should immediately notify us.
We offer our products on this website within the limits of our available stocks. Your orders are subject to minimum and maximum quantity limitations. We also reserve the right to refuse orders, notably in case of insolvency, unpaid invoices or fraud. You need to inform us as soon as possible when your address or other details have changed. The order you place on this website will not constitute a binding agreement unless and until we transmit a confirmation to you by e-mail. Your order data acknowledged by us constitutes proof of the order and the entire transaction. The data registered by our payment system constitutes proof of the financial transactions.
The prices payable for the items you order are those valid on the date you place your order, and are subject to taxes and delivery charges. Delivery charges will be billed at the rates indicated on this website/mobile app or communicated on the phone on the date you place your order. In the case of writing, printing or calculation errors made by us, we reserve the right to amend the price if you are agreeable, or cancel the order or agreement if you are not.
When ordering products for international delivery to countries other than those where our shipments originate (the U.S. for the U.S., Canada and Latin American markets) (France for the British and European markets), you are the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. You may be subject to import duties and taxes that are levied once the merchandise reaches your country. Any additional charges for customs clearance must be borne by you. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country so you should contact your local customs office for further information.
All orders confirmed by us will be delivered to the delivery address you specify when placing your order. The risks of the goods being lost or damaged are transferred to the customer at the time of delivery. In a case where we have not managed to deliver the goods within 30 days of the day of our confirmation of your purchase, you have the right to cancel the order without any cost and receive a full refund of the product costs, taxes, and delivery charges that you have paid.
Payment shall be made by credit card through Shopify, or by PayPal, or by Apple Pay, and is immediately due and payable before ordered products are dispatched. All recurrent orders shall be billed in the same manner as your original order. Your credit card and payment details will be encrypted for security purposes.
Limitation of Liability
The photographs and texts illustrating and describing the products on this website and on mobile apps are non-contractual and for information purposes alone. Except in case of willful misconduct or gross negligence, Mark Legere Collections shall not be liable in case of errors or omissions in the photographs or texts displayed on our website.
For international deliveries to countries other than those where our shipments originate, (the U.S. for the U.S., Canada and Latin American markets) (France for the British and European markets), Mark Legere Collections shall have no liability if the products do not comply with the laws and regulations of the country of delivery or other product incompatibility.
Without limiting the scope of these Conditions of Sale, no claim of any kind, whether as to products delivered or non-delivery of products, shall be greater in amount than the purchase price of the products in respect of which damages are claimed. IN NO EVENT SHALL Mark Legere Collections BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE (EVEN IF THE ADVENT OF SUCH DAMAGE WAS KNOWN OR COULD HAVE BEEN KNOWN BY Mark Legere Collections), CAPABLE OF ARISING IN CONNECTION WITH OUR PRODUCTS, THEIR USE, SALE OR THIS WEBSITE.
Mark Legere Collections will make every reasonable effort to fulfill its obligations. However, we cannot be held responsible for delays or failure to deliver caused by circumstances beyond our reasonable control. Such circumstances include strikes, wars, natural catastrophes or any others that make impracticable the production, transportation or delivery of products.
In the event of delay, we will perform our obligations as soon as reasonably possible, and we reserve the right to allocate any remaining product supply among customers in a fair and reasonable manner.
Applicable Law and Forum
These Conditions of Sale shall be governed by and construed in accordance with the laws of the State of New York. New York State shall be the exclusive jurisdiction and New York County and/or the Southern District of New York shall be the exclusive venue.
